Data privacy is highly important to us and we want to be open and transparent with our processing of your personal data. 

We have developed this Privacy Policy to set out for you how your personal data will be processed and protected.

“Customer” means the person, company or entity that has contracted with Quest to have access to use our survey platform under a Licensing Agreement.

“Services” means our website, survey platform and services, webinars, blogs, consultancy, newsletters or events.

“Users” means any person that uses our survey platform under a Licensing Agreement.

What data do we collect?

Contact Details: when you contact us or subscribe to any of our Services we will collect your name, business name, email address and/or telephone number.

Information from interacting with us on social media: for example, communications through LinkedIn.

Third Parties: we may collect personal information from third parties if you have given your permission for those third parties to share your information with us. The third party may be a Customer, for example your Employer, however, in these circumstances your personal information will only be used to provide you with access to the survey platform as agreed in the Licensing Agreement and will not be used for any marketing purposes.

Who is the controller of your personal data?

Quest Agency Limited (“Quest”), is the controller of the personal data you submit to us through our website or marketing activities and in these circumstances Quest is responsible for your personal data under the applicable data protection law.

When using the survey platform – Quest is the processor and the Customer is the controller of the personal data. In these circumstances Quest will only use personal data to provide the Services agreed with the Customer in the Licensing Agreement.

Why do we use your personal data?

We will use your contact details to send you marketing offers, information and invitations through e-mails, text messages, phone calls and postal mail.

Where do we store your data?

The data that we collect from you is stored within the UK/European Economic Area (“EEA”) it is unlikely that your data will be transferred to and processed in a country outside of the UK/EEA. However, if any such transfer of your personal data is carried out it will be in compliance with the applicable laws. For transfers outside the EEA, Quest will use Standard Contractual Clauses and Shields as safeguards for countries without adequacy decisions from the European Commission.

Who can access your data?

Your data will be used within Quest and, where necessary to provide you with the Services it will be shared only with Quest’s sub-contractors and affiliates. We never sell your data to third parties. 

What is the legal ground for processing?

The processing of your personal data is based on the lawful basis of legitimate interests.

What are your rights?

Right to access: You have the right to request information about the personal data we hold on you at any time. You can contact Quest at admin@questagency.co.uk and we will provide you with your personal data via e-mail.

Right to portability: Whenever Quest processes your personal data, by automated means based on your consent or based on an agreement, you have the right to get a copy of your data transferred to you or to another party. This only includes the personal data you have submitted to us.

Right to rectification: You have the right to request rectification of your personal data if the information is incorrect, including the right to have incomplete personal data completed.

Right to erasure: You have the right to erase any personal data processed by Quest at any time except where your employer is a Customer of Quest and the personal data has been provided by them.  In these circumstances you will need to contact the Customer directly to address any personal data queries.

Your right to object to processing based on legitimate interest:  
You have the right to object to processing of your personal data that is based on Quest’s legitimate interest. Quest will not continue to process the personal data unless we can demonstrate legitimate grounds for the process which overrides your interest and rights or due to legal claims.

Right to restriction: Subject to exemptions, you have the right to request that Quest restricts the processing of your personal data under the following circumstances:

  • the accuracy of the personal data is contested by you
  • you believe processing is unlawful
  • you believe that we no longer need the personal data for the purposes of processing
  • you have objected to processing of your personal data pending the verification of whether there are legitimate grounds for us to override these objections

Right to not be subject to decisions based solely on automated processing: we do not carry out any automated processing, which may lead to an automated decision based on your personal data.

Right to withdraw your consent: You have the right to withdraw your consent for the processing of your personal data at any time. You can opt out by following the instructions below or the instructions in each marketing post or email.

Right to complain: If you consider Quest has processed your personal data in an incorrect way you can contact us at the email address in the paragraph below. You also have the right to raise a complaint to a supervisory authority such as the Information Commissioners Office (ICO) in the UK, please refer to the ICO website.

How can you exercise your rights?

We take data protection very seriously and therefore we have a member of staff to handle your requests in relation to your rights stated above and to ensure that we process your personal data in an open, accurate and legal manner. How long do we save your data?

We will keep your data for marketing until you withdraw your consent.  For e-mail marketing we will consider you an inactive customer if you haven’t opened an e-mail within the last year. After this time period your personal data will be deleted.  For Users of the survey platform any personal data will be deleted at the end of the Licensing Agreement.

Change in Control or sale

If ownership of Quest, or any part of Quest, changes you expressly consent to Quest transferring your information to the new owner or successor so that we can continue providing our Services. The new owner will, in line with this privacy policy, be permitted to use your personal information for the purposes for which it was supplied by you.

Cookies

A cookie is a small text file that is saved to, and, during subsequent visits, retrieved from your computer or mobile device. If you use our Services, we will assume that you agree to the use of such cookies.

How do we use cookies?
We use cookies to remember users’ settings and preferences and for session management. Users can control the use of cookies at the individual browser level.  If you reject cookies you may still use our website and Services, but your ability to use some of the features may be limited.

How long do we save your data?
You can easily erase cookies from your computer or mobile device using your browser. For instructions on how to handle and delete cookies please look under “Help” in your browser. This privacy policy is regularly reviewed to make sure that we continue to meet the highest standards and to protect your privacy.  We reserve the right, at all times, to update, modify or amend this policy. The latest version of this policy is available on our website. Any significant changes or updates we make to our privacy policy may be notified to you by email. Your continued use of the platform will signify that you agree to any such changes.
